" ... when can and should an individual recover monetary compensation in respect of loss caused by administrative action and on what basis should any such compensation be assessed? Although the courts have done much to develop public law principles, they have
considered that it goes beyond their proper role to create a new right to
compensation for maladministration. Attempts have been made to develop the
law of negligence in an incremental fashion to include some such claims."
